LIQUOR LICENSING AUTHORITY MINUTES
Regular Meeting. – August 16, 2023

A regular meeting of the Liquor Licensing Authority was held August 16, 2023, via Zoom Link,
Assistant Municipal Judge Brandi Nieto presiding.
Secretary’s Note: All applications were heard via Zoom.

Liquor Enforcement Update
Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random
compliance checks:
July 18, 2023, visiting 16 liquor licensed establishments of which 1 served the underage
operative: a failure rate of 6.25% for the evening.
Liquor Enforcement Officer Ripsam stated that the overall failure rate is 8.2 % for 2023.
Show Cause Hearing for Tivine, LLC, dba
Island Grill, 2601 South Lemay Avenue, Suite 12, Stipulation Agreement
Andy Gavaldon, attorney representing Tivine, LLC, stated he has had an opportunity to review the
stipulation agreement with his client and that they have agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 20-day suspension, 8 days served (paid $2834.47 fine in lieu of suspension), with 12 days
held in abeyance for one year for violating Colorado Liquor Code Section 44-03-901(1)(a) prohibiting
the sale to visibly intoxicated person by employee [violation date February 14, 2023].

Assistant Municipal Judge Nieto approved the findings, conclusion, and order, accepting the
stipulation agreement as presented for Tivine, LLC, dba Island Grill, 2601 South Lemay Avenue, Suite
12.
Show Cause Hearing for Naki, LLC, dba
Nori Maki Bar, 2842 Council Tree Avenue, Stipulation Agreement
Richard Liu, representative for Maki, LLC, stated he has had an opportunity to review the stipulation
agreement and that he has agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held
in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the
service of an alcoholic beverage to a person under the age of twenty-one years.
Assistant Municipal Judge Nieto approved the findings, conclusion, and order, accepted the
stipulation agreement as presented for Nori Maki Bar, 2842 Council Tree Avenue.
Show Cause Hearing for Regional Fort Collins, LLC, dba
Regional Fort Collins, 130 South Mason Street, Stipulation Agreement
James Gladstone, representative for Regional Fort Collins, LLC, stated he has had an opportunity to
review the stipulation agreement and that he has agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 15-day suspension, 5 days served (paid $1183.55 fine in lieu of suspension), with 10 days
held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I)
prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years.
Assistant Municipal Judge Nieto approved the findings, conclusion, and order, accepted the
stipulation agreement as presented for Regional Fort Collins, LLC, dba Regional Fort Collins, 130
South Mason Street.
Transfer of Ownership Application from AC Brothers, LLC, dba
Pour Brothers, 220 Linden Street, Approved
Chris and Kristin Qualls, representatives for AC Brothers, LLC, stated that they are in the process
training all their employees with regards to the sale and service of alcohol. Ms. Qualls stated she has
already signed up for the State Notification listserv.
Assistant Municipal Judge Nieto approved the transfer of ownership from AC Brothers, LLC, dba
Pour Brothers, 220 Linden Street.

New Hotel-Restaurant Liquor License Application from
MDE Project, Inc., dba Yellow Crunch, 234 North College Avenue, Suite B1, Approved
Viviana Henao, representative for MDE Project, Inc., was sworn. In response to questions from the
Authority, Ms. Henao stated she has worked in the liquor industry for several years and is familiar
with the sale and service of alcohol.
Patrick Maroney, Alcohol Petitioning Services, was sworn. Mr. Maroney described the petitioning
process stating that the result of this survey indicates strong support for this application.
Assistant Municipal Judge Nieto adopted Resolution 2023-010 approving the hotel-restaurant liquor
license application from MDE Project, Inc., dba Yellow Crunch, 234 North College Avenue, Suite
B1.
