November 17, 2022
A regular meeting of the Building Review Commission was held on Thursday, November 17,
2022, at 9:00 a.m. via Zoom.

Chair Cram called the meeting to order at 9:00 a.m.

•DISCUSSION AGENDA
1.CONSIDERATION AND APPROVAL OF THE MINUTES OF THE OCTOBER 27, 2022
MEETING.
Moscrip moved to approve the minutes of the October 27, 2022 meeting. Dunbar
seconded. The motion passed 3-0, with Cram abstaining.

2. REMOTE ORDINANCE PARTICIPATION
DESCRIPTION: The purpose of this item is to give the commission the opportunity to
voice support or concern with an ordinance intended to be presented
to Council on December 6th to (re)-allow remote participation at
hearings. While a recommendation on this matter from the BRC is not
required, all potentially affected commissions are welcome to provide
a recommendation about the new ordinance, which would re-establish
the possibility of remote participation for meetings beginning in 2023.

Staff Presentation & Board Discussion
Russ Hovland, Acting Chief Building Official, gave the staff presentation. He discussed the
possible hearing formats and outlined procedures the Commission would follow under hybrid,
remote, or in-person participation.
Aaron Guin, CAO, discussed the City Code. He noted due process considerations of a quasi-
judicial board, including notice, opportunity to be heard, and fairness. He discussed possible
motions and considerations the Commission may make on this issue.
Member Dunbar and Hovland discussed the hybrid meeting format.
Guin mentioned that future meetings will require coordination and communication between
City staff, Commission Members, members of the pubic, and interested parties.
Member Moscrip described the possible difficulties of holding a remote hearing, including that
members of the public may show up to appear in person.
Chair Cram expressed concerns that the Commission may hold a remote hearing, but the
applicant/appellant might want the Members to appear in person.
Guin discussed Commission hearing procedures and possible language to include in its
memo to Council.
Chair Cram discussed that he places a high value on remote participation for its convenience,
if anyone has health concerns, and appreciated a hybrid meeting format.
Moscrip moved that the Building Review Commission recommend approval of the
proposed ordinance to allow for remote participation in quasi-judicial meetings based
on the staff findings included in the Building Review Commission November 17, 2022
Agenda Packet.
Dunbar seconded. The motion passed 4-0.

Chair Cram requested updates on the December meeting, if any. Matsunaka noted that zero
appeals have been timely filed and there were not any other known agenda items. Cram
wished everyone a Happy Thanksgiving and Holiday Season!

Chair Cram adjourned the meeting at 9:21 a.m.
