LIQUOR LICENSING AUTHORITY MINUTES
Regular Meeting. – March 15, 2023

A regular meeting of the Liquor Licensing Authority was held March 15, 2023, via Zoom Link, Chief
Judge Jill Hueser presiding.
Secretary’s Note: All applications were heard via Zoom.

Liquor Enforcement Update
Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random
compliance checks:
February 15, 2023, visiting 20 liquor licensed establishments of which none served the
underage operative.
February 18, 2023, visiting 18 liquor licensed establishments of which 2 served the underage
operative: a failure rate of 11.11% for the evening.
Liquor Enforcement Officer Ripsam stated that the overall failure rate is 5.97% for 2023.
Show Cause Hearing for Los Tarascos, Inc., dba
Los Tarascos, 622 South College Avenue, Stipulation Agreement Approved
Priscilla Caballero, representative for Los Tarascos, Inc., stated she has had an opportunity to review
the stipulation agreement and that she has agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 80-day suspension, 10 days to be an actual suspension with no service of alcohol from the
start of business on March 16, 2023, through the end of business on March 25, 2023, 30 days served
(paid $4660.89 fine in lieu of suspension), with 40 days held in abeyance for one year for violating

Colorado Liquor Code Section 44-3-901(1)(a) prohibiting the sale to three visibly intoxicated persons
by an employee.
Chief Judge Hueser approved the findings, conclusion, and order, accepting the stipulation agreement
as presented for Los Tarascos, Inc., dba Los Tarascos, 622 South College Avenue.
Show Cause Hearing for Seneca Beer, LLC, dba
Seneca Beer, 1709 West Harmony Road, Stipulation Agreement
Matthew Rimmer, representative for Seneca Beer, LLC, stated he has had an opportunity to review
the stipulation agreement and that he has agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held
in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the
service of an alcoholic beverage to a person under the age of twenty-one years.
Chief Judge Hueser approved the findings, conclusion, and order, accepting the stipulation agreement
as presented for Seneca Beer, LLC, dba Seneca Beer, 1709 West Harmony Road.
Show Cause Hearing for Batdog, LLC, dba
Surfside Seven Café, 238 Linden Street, Stipulation Agreement
Zachary Wilson, attorney representing Batdog, LLC, stated he has had an opportunity to review the
stipulation agreement and that they have agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 15-day suspension, 5 days served (paid $938.25 fine in lieu of suspension), with 10 days
held in abeyance for one year for violating City of Fort Collins Municipal Code 3-81 – report of
disturbances.
Chief Judge Hueser approved the findings, conclusion, and order, accepting the stipulation agreement
as presented for Batdog, LLC, dba Surfside Seven Café, 238 Linden Street.
Temporary Modification of Application from Music City Hot Chicken, LLC
dba Music City Hot Chicken, 111 West Prospect Road, #C, Approved
Samuel Graf, representative for Music City Hot Chicken, LLC, briefly described the proposed events
that these temporary modifications are being requested for.

Patricia Acheson, representative for No Waste Coffee, LLC, detailed the proposed modifications. She
stated she will have staff frequently checking the patio area.

manager, was available for questions.

Transfer of Ownership Application from FoCo Pickle Barrel, LLC, dba
B&B Pickle Barrel, 122 West Laurel Street, Approved
Mike Jensen, representative for FoCo Pickle Barrel, LLC, stated they will require all employees that
will be serving alcohol will be required to complete TIPs or equivalent training. He stated with their
proximity to Colorado State University they are aware of how important it is to be vigilant.

Transfer of Ownership Application from Holm Cookin’, LLC, dba
Rise! A Breakfast Place, 2601 South Lemay Avenue, Unit 31, Approved
Zachary Holm, representative for Holm Cookin’, LLC, stated he has been in the restaurant business
for several years and that he has instructed his employees to not accept vertical ids.
Chief Judge Hueser approved the transfer of ownership application from Holm Cookin’, LLC, dba
Rise! A Breakfast Place, 2601 South Lemay Avenue, Unit 31.
New Beer and Wine Application from Tuan The Than, dba
The Nail Spa, 4350 South College Avenue, Suite 6B, Approved
Tuan The Than, was sworn, and stated he will wishes to serve his customers wine or beer with their
service. He stated he or his wife will only be allowed to serve. Mr. Than stated he will attend training
regarding the service of alcohol.
Mr. Than briefly described the petitioning process and that it indicates support from the neighborhood
for this application.
Chief Judge Hueser adopted Resolution 2023-002 approving a beer and wine license from Tuan The
Than, dba The Nail Spa, 4350 South College Avenue.
New Hotel-Restaurant Liquor License Application from NF Colorado, LLC,
dba Native Foods Café, 3300 South College Avenue, Unit #110, Approved
Brandon Sandberg, attorney representing NF Colorado, LLC, stated Jason Metrick, business
representative, was available for questions. In response to a question from the Authority, Mr. Metrick
stated that any employee found in violation of the liquor code is immediately terminated.
Eva Garretson, representative for LiquorPros, LLC, was sworn. She detailed the petitioning process,
stating the results indicate support from the neighborhood for this application.
Chief Judge Hueser adopted Resolution 2023-003 approving a hotel-restaurant liquor license
application from NF Colorado, LLC, dba Native Foods Café, 3300 South College Avenue.
