Secretary’s Note: All applications were heard via Zoom. Staff in attendance: Jenny Lopez-Filkins Senior City Attorney II Carrie Ripsam, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Consent Agenda Approved:  Minutes from the March 17, 2022, meeting. Liquor Enforcement Update Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks:  March 25, 2022, visiting 18 liquor licensed establishments of which 2 served the underage operative: a failure rate of 11% for the evening.  April 6, 2022, visiting 17 liquor licensed establishments of which 4 served the underage operative: a failure rate of 24% for the evening.  April 19, 2022, visiting 21 liquor licensed establishments of which 1 failed; a failure rate of 18% for the evening. Liquor Enforcement Officer Ripsam stated that the overall failure rate is 17.7% so far for 2022. Show Cause Hearing for Lilly-Julian, Inc./7-Eleven, Inc., dba 7-Eleven Store #202104A, 430 Remington Street Stipulation Agreement Accepted Kevin Coates, attorney representative for Lilly-Julian, Inc./7-Eleven, Inc., stated he has had an opportunity to review the stipulation agreement with his client and that they have agreed to the terms. Senior City Attorney Lopez-Filkins reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 DocuSign Envelope ID: 6157ED80-72DE-401E-9217-51B049028FF8 March 17, 2022 P a g e 2 | 5 days held in abeyance for one year for violating Colorado Liquor Code Section 44-03-301(4)(a), local and state liquor licenses were expired, 44-03-302(1) local liquor license was not renewed within the forty-five days prior to the date of expiration, and 44-03-302(1) state liquor license was not renewed within the thirty days prior to the date of the expiration. Assistant Judge Nieto approved the findings, conclusion, and order, accepting the stipulation agreement as presented for Lilly-Julian, Inc./7-Eleven, Inc., dba7-Eleven #202104A, 430 Remington Street. Show Cause Hearing for Prosperous Thai Restaurant, LLC, dba Bann Thai Front Range, 2721 Council Tree Avenue, Unit 137 Stipulation Agreement Accepted Sudtida Chaiamnuay, representative for Prosperous Thai Restaurant, LLC, stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. Senior Assistant City Attorney Lopez-Filkins reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (from start of business on April 22, 2022 through end of business on April 26, 2022), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Assistant Judge Nieto approved the findings, conclusion, and order, accepting the stipulation agreement as presented for Prosperous Thai Restaurant, LLC, dba Bann Thai Front Range, 2721 Council Tree Avenue, Unit 137. Show Cause Hearing for GottiWebs, LLC, dba Bondi Beach Bar, 11 Old Town Square, Suite 120 Stipulation Agreement Accepted Nicholas Gottsacker, representative for GottiWebs, LLC, stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. Senior Assistant City Attorney Lopez-Filkins reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $3770.63 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3- 901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Assistant Judge Nieto approved the findings, conclusion, and order, accepting the stipulation agreement as presented for GottiWebs, LLC, dba Bondi Beach Bar, 11 Old Town Square, Suite 120. Assistant Judge Nieto approved the manager registration application from Ovations Food Services, LP, dba Canvas Stadium at Sonny Lubick Field, 751 West Pitkin Street. Manager Registration Application from Tokyo, Inc., dba Tokyo Joe’s, 100 West Troutman Parkway, Approved Aston Woy, manager applicant, briefly described his background. He stated he has instructed his employees to not accept vertical id’s. William C. Wildberger, attorney representing Tokyo, Inc., addressed failed compliance checks of other Tokyo Joe locations. Assistant Judge Nieto approved the manager registration application from Tokyo, Inc., dba Tokyo Joe’s, 100 West Troutman Parkway. Manager Registration Application from Rocky Mountain Restaurant Group, Inc., dba Urban Egg A Daytime Eatery, 230 South College Avenue, Approved David Koch, manager applicant, briefly described his background. Assistant Judge Nieto approved the manager registration application from Rocky Mountain Restaurant Group, Inc., dba Urban Egg A Daytime Eatery, 230 South College Avenue. Modification of Premise Application from Bowl Fort Collins, LLC, dba Chipper’s Lanes, 217 West Horsetooth Road, Approved Matthew Hoeven, representatives for Bowl Fort Collins, LLC. He briefly described the proposed changes, stating they are expanding the volleyball courts and that there are no changes to how alcohol is served or stored. Assistant Judge Nieto approved the modification of premise application from Bowl Fort Collins, LLC, dba Chipper’s Lanes, 217 West Horsetooth Road. She briefly described the proposed changes, stating they are adding an additional outdoor and indoor area for special events. Assistant Judge Nieto approved the modification of premise application from Tap and Handle Partners, LLC, dba Tap and Handle, 307 South College Avenue. New Hotel-Restaurant Liquor License Application from Generation Next Corp, dba Mugs at CSU, 306 West Laurel Street, Suite 130, Approved McCabe and Marli Callahan, representatives for Generation Next Corp, were sworn. In response to questions from the Authority, Ms. Callahan briefly described the petitioning process stating that the designated neighborhood supports this application. Mr. Callahan stated they will not accept vertical id’s. Ms. Callahan stated that employees will be required to be TIPs or equivalent training. Assistant Judge Nieto adopted Resolution 2022-012 approving a hotel-restaurant liquor license application from Generation Next Corp, dba Mugs at CSU at 306 West Laurel Street, Suite 130. New Brew Pub Application from Persimmon Goods, LLC, dba Persimmon, 251 Jefferson Street, Approved Raffi Jergerian, representative for Persimmon Goods, LLC, was sworn. He briefly described the petitioning process stating that the designated neighborhood supports this application. Mr. Jergerian described the premises, stating that the previous tenant was a winery. Assistant Judge Nieto adopted Resolution 2022-010 approving a hotel-restaurant liquor license from Persimmon Goods, LLC, dba Persimmon at 251 Jefferson Street. New Fermented Malt Beverage License Application from Seneca Beer, LLC dba Seneca Beer, 1709 West Harmony Road, Approved Matthew Rimmer, representative for Seneca Beer, LLC, was sworn. He stated since the liquor store across the parking lot has closed and that his customers are requesting the ability to purchase fermented malt beverages. Eva Garretson, representative for Liquor Licensing Professionals, LLC was sworn. She detailed how the petitioning was conducted, stating that the designated neighborhood supports this application. Assistant Judge Nieto adopted Resolution 2022-011 approving a fermented malt beverage license from Seneca Beer, LLC, dba Seneca Beer, 1709 West Harmony Road.
