Secretary’s Note: All applications were heard via Zoom. Staff in attendance: Bronwyn Scurlock, Assistant City Attorney II Carrie Ripsam, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Consent Agenda Approved: · Minutes from the January 20, 2022, meeting. · Tastings Permit Application from Shidhi Binayak, LLC, dba Pringle’s Fine Wine & Spirits, 2100 West Drake Road, #11. Liquor Enforcement Update Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks: · January 25, 2022, visiting 15 liquor licensed establishments of which 5 served the underage operative: a failure rate of 33% for the evening. · February 8, 2022, visiting 12 liquor licensed establishments of which 4 served the underage operative: a failure rate of 33% for the evening. · February 16, 2022, visiting 13 liquor licensed establishments of which 1 failed; a failure rate of 7.69% for the evening. Liquor Enforcement Officer Ripsam stated that the overall failure rate is 22.06% so far for 2022. Show Cause Hearing for MM VanDeList, Inc./7-Eleven, Inc. dba 7-Eleven Store #26927B, 1600 South Lemay Avenue Stipulation Agreement Accepted Kevin Coates, attorney representative for MM VanDeList, Inc.;7-Eleven, Inc., stated he has had an opportunity to review the stipulation agreement with his client and that they have agreed to the terms. Judge Hueser approved the findings, conclusion, and order, accepting the stipulation agreement as presented for MM VanDeList, Inc./7-Eleven, Inc., dba7-Eleven #26927B, 1600 South Lemay Avenue. Show Cause Hearing for Aldretex, Inc. dba 287 Craft Spirits, 5846 South College Avenue Stipulation Agreement Accepted Raul Aldrete, representative for Aldretex, Inc., stated he has had an opportunity to review the stipulation agreement and that he has agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $3170.24 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-03-302(1) local liquor license was not renewed within the forty-five days prior to the date of expiration, 44-03-302(1) state liquor license was not renewed within the thirty days prior to the date of the expiration, and 44-03- 301(4)(a) local and state liquor licenses were expired. Judge Hueser approved the findings, conclusion, and order, accepting the stipulation agreement as presented for Aldretex, Inc., dba 287 Craft Spirits, 5846 South College Avenue. Show Cause Hearing for Surprise Valley, LTD, dba Garlic Knot, 2601 South Lemay Avenue, Unit 30 Stipulation Agreement Accepted Stephen Madden, representing Surprise Valley, LTD, stated he has had an opportunity to review the stipulation agreement and that he has agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Hueser approved the findings, conclusion, and order, accepting the stipulation agreement as presented for Surprise Valley, LTD, dba Garlic Knot, 2601 South Lemay Avenue, Unit 30. Show Cause Hearing for Magnolia Street Liquors, LLC dba Magnolia Street Market, 710 East Magnolia Street Stipulation Agreement Accepted Zachary Owens, representative for Magnolia Street Liquors, LLC, stated he has had an opportunity to review the stipulation agreement and that he has agreed to the terms. Judge Hueser approved the findings, conclusion, and order, accepting the stipulation agreement as presented for Magnolia Street Liquors, LLC, dba Magnolia Street Market, 710 East Magnolia Street. Show Cause Hearing for Robbins, LLC, dba Matt’s Place, 6013 South College Avenue Stipulation Agreement Accepted Matt Robbins, representing Robbins, LLC, stated he has had an opportunity to review the stipulation agreement and that he has agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $1289.98 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Hueser approved the findings, conclusion, and order, accepting the stipulation agreement as presented for Surprise Valley, LTD, dba Garlic Knot, 2601 South Lemay Avenue, Unit 30. Manager Registration Application from Pool IV TRS, LLC, dba Hilton Fort Collins, 425 West Prospect, Approved Daniel Benton, manager applicant, briefly described his background. He stated there was a failed compliance check at this location just as he arrived as the general manager. Judge Hueser approved the manager registration application from Pool IV TRS, LLC, dba Hilton Fort Collins, 425 West Prospect. Manager Registration Application from Mongolian Grill Restaurant Operating Company, LLC, dba HuHot Mongolian Grill, 249 South College Avenue, Approved Heidi Shideler, manager applicant, briefly described her background. She stated all employees involved in the sale and service of alcohol are required to be SafeServ or TIPs trained. Judge Hueser approved the manager registration application from Mongolian Grill Restaurant Operating Company, LLC, dba HuHot Mongolian Grill, 249 South College Avenue. Ms. Rump stated that any employee found in violation of the liquor code will be retrained. Judge Hueser approved the transfer of ownership of Page Rump Holdings, LLC, dba Board & Brush Creative Studio, 244 North College Avenue, Unit 115. Transfer of Ownership of Leonor’s Shop, LLC, dba Pinot’s Palette, 159 West Mountain Avenue, Approved Will and Desiree Rich, representatives for Leonor’s Shop, LLC, stated they are requesting a transfer of ownership. Mr. Rich stated any employee found in violation of the liquor code will be immediately terminated and the entire staff will be retrained. He stated all employees involved in the sale and service of alcohol will be required to be trained prior to be allowing to serve. Judge Hueser approved the transfer of ownership of Leonor’s Shop, LLC, dba Pinot’s Palette, 159 West Mountain Avenue. Transfer of Ownership of TheRegionalFortCollins, LLC, dba The Regional, 130 South Mason Street, Approved James Gladstone, representative for TheRegionalFortCollins, LLC, stated he is requesting a transfer of ownership for this location. He stated any violation by an employee will be reviewed on a case-by- case basis. Mr. Gladstone stated that he has retained all the employees from the previous ownership and are trained with respect to the sale and service of alcohol. Judge Hueser approved the transfer of ownership of TheRegionalFortCollins, LLC, dba The Regional, 130 South Mason Street. Transfer of Ownership of Dish Up, LLC, dba Silver Grill Café, 218 Walnut Street, Approved Alan Jantzen, representative for Dish Up, LLC, stated he is requesting a transfer of ownership for this location. He stated any employee found in violation of the liquor code will be immediately terminated and that since he has taken over the business, he has identified training issues. Judge Hueser approved the transfer of ownership of Dish Up, LLC dba Silver Grill Café, 218 Walnut Street.
