HomeMy WebLinkAboutLiquor Licensing Authority - Minutes - 04/15/2021 LIQUOR LICENSING AUTHORITY MINUTES Regular Meeting. – April 15, 2021 1:00 p.m. Staff Liaison: Aimee Jensen A regular meeting of the Liquor Licensing Authority was held April 15, 2021 in Municipal Court, 215 North Mason Chief Judge Jill Hueser presiding. Secretary’s Note: All applications were heard via Zoom. Staff in attendance: Bronwyn Scurlock, Assistant City Attorney II Carrie Ripsam, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Consent Agenda Approved:  Minutes from the March 18, 2021.  Uptown Liquors Tastings Permit Application Liquor Enforcement Update Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks:  March 10, 2021, visiting 13 liquor licensed establishments of which 3 served the underage operative: a failure rate of 23.1%. Show Cause Hearing for Kung-Food Kitchen, Inc., dba Simply Thai, 2531 South Shields Street, 2-M, Stipulation Agreement Accepted Yun Jia Tang, representative for Kung-Food Kitchen, Inc., stated they have agreed to the terms of the stipulation agreement. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15 day suspension, 5 days served (paid $500 fine lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Kung-Food, Inc., dba Simply Thai, 2531 South Shields Street 2-M. DocuSign Envelope ID: 8119867E-E725-4162-9DB1-889B326FAB22 April 15, 2021  Page 2 | 3    Show Cause Hearing for Samuel Glen, Inc., dba Steak-Out Saloon, 152 West Mountain Avenue, Stipulation Agreement Accepted Zach Wilson, attorney representing Samuel Glen, Inc., stated they have agreed to the terms of the stipulation agreement. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 20 day suspension, 10 days served (paid $1098.66 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(a) to sell, serve, give away, dispose of, exchange, or deliver, or permit the sale, serving, giving or procuring of, any alcohol beverage to a visibly intoxicated person and Colorado Liquor Regulation 47-900 conduct of establishment (A) orderliness, loitering, serving of intoxicated persons. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Samuel Glen, Inc., dba Steak-Out Saloon, 152 West Mountain Avenue. Manager Registration Application from B2W, LLC, dba Ryan’s Sports Grill, 925 East Harmony Road, Unit 10, Approved Gary Winham, manager applicant, briefly described his background. He stated any patron ordering an alcoholic beverage that appears to be under the age of 40 is carded and that they no longer accept vertical id’s. Mr. Winham stated that they are requiring all employees to be achieve ServSafe certification. He stated any employee intentionally violating the liquor code will be immediately terminated. Judge Hueser approved the manager registration application from B2W, LLC, dba Ryan’s Sports Grill, 925 East Harmony Road, Unit 10. Temporary Modification of Premise Application from The Tasting Group, LLC dba Social, 1 Old Town Square #7, Approved Ty Fulcher, representative for The Tasting Group, LLC, briefly described the requested modification of premise. He stated this proposed patio will be inside Old Town Square and that they will have a door person sitting at the entrance of the patio. Judge Hueser approved the temporary modification of premise application from The Tasting Group, LLC, dba Social, 1 Old Town Square #7. Transfer of Ownership Application from JM Store, Inc., dba Prospect Liquors, 1115 West Prospect Road, #105, Approved Kris Hoeltgen, attorney representing JM Store, Inc., stated they are ready to proceed. In response to questions from Jong Won Kim, also representative for JM Store, Inc., stated he has 3 employees and that he will be trained in ServSafe. He stated if any employee found in violation of the liquor code would be immediately terminated. New Application for a Hotel-Restaurant Liquor License from 1998, LLC, dba Cheba Hut, 2550 East Harmony Road, Suite 102, Approved AND Manager Application from 1998 LLC, dba Cheba Hut, 2550 East Harmony Road, Suite 102, Approved Marc Torres and Scott Jennings, representatives for 1998, LLC, and Cody Elgin, manager applicant, were sworn. Mr. Torres briefly described his background. He stated employees are not allowed to consume alcoholic beverages on premise and that any employee found in violation of the liquor code will be immediately terminated. In response to questions from the Authority, Cody Elgin, briefly described the petitioning process. He stated they collected 154 signatures, 12 struck, which left them with 142 valid signatures supporting this application. Mr. Elgin stated all employees involved in the sale and service of alcohol will be required to successfully complete TIPs or equivalent training. Judge Hueser adopted Resolution 2021-010 approved a hotel-restaurant liquor license and approved the manager registration application from 1998, LLC, dba Cheba Hut, 2550 East Harmony Road, Suite 102.
