Secretary’s Note: All applications were heard via Zoom. Staff in attendance: Holly Coulehan, Assistant City Attorney II Carrie Ripsam, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Consent Agenda Approved:  Minutes from September 15, 2022. Liquor Enforcement Update Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks:  September 19, 2022, visiting 17 liquor licensed establishments of which 1 served the underage operative: a failure rate of 5.88% for the evening.  October 5, visiting 9 liquor licensed establishments of which 4 served the underage operative: a failure rate of 44.44%.  October 10, 2022, visiting 11 liquor licensed establishments of which 2 served the underage operative: a failure rate of 18% for the evening. Liquor Enforcement Officer Ripsam stated that the overall failure rate is 14.01 % for 2022. Show Cause Hearing for Ciao Vino Fort Collins, dba Ciao Vino Fort Collins, 255 Linden Street, Stipulation Agreement Andrew Bertrand, attorney representing Ciao Vino Fort Collins, stated he has had an opportunity to review the stipulation agreement with his client and that they have agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (from start of business on September 21, DocuSign Envelope ID: F6A83001-F575-4AE6-87D2-950A915C80E6 October 20, 2022 P a g e 2 | 3 2022, through end of business on September 25, 2022), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Chief Judge Hueser approved the findings, conclusion, and order, accepting the stipulation agreement as presented for Ciao Vino Fort Collins, dba Ciao Vino Fort Collins, 255 Linden Street. Show Cause Hearing for Best Pizza, LLC, dba Mod Pizza, 1013 Centre Avenue, Stipulation Agreement Kevin Coates, attorney representing Best Pizza, LLC, stated he has had an opportunity to review the stipulation agreement with his client and that they have agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Chief Judge Hueser approved the findings, conclusion, and order, accepted the stipulation agreement as presented for Best Pizza, LLC, dba Mod Pizza, 1013 Centre Avenue. Modification of Premise Application from Dillon Companies, LLC, dba King Soopers #99, 1842 North College Avenue, Approved Adam Stapen, attorney representing Dillon Companies, LLC, briefly described the proposed changes, stating that they are adding an end cap and expanding the beer cooler. Chief Judge Hueser approved the modification of premise application from Dillon Companies, LLC, dba King Soopers #99, 1842 North College Avenue. Modification of Premise Application from Board of Governors CSU System, dba Lory Student Center – CSU, 1101 Center Avenue Mall, Approved Geoffrey Valdez, representative for the Board of Governors CSU System, briefly described the proposed changes, stating they are adding a third floor to the north end of the Lory Student Center. Chief Judge Hueser approved the modification of premise application from Board of Governors CSU System, dba Lory Student Center – CSU, 1101 Center Avenue Mall. Sidewalk Service Area Permit Application from Mountain Creole, Inc., dba Lucile’s, 400 South Meldrum Street, Approved Tony Hanks, representative for Mountain Creole, Inc., briefly described the proposed changes, stating that they are permanently adding the COVID temporary modification of premise to their DocuSign Envelope ID: F6A83001-F575-4AE6-87D2-950A915C80E6 October 20, 2022 P a g e 3 | 3 liquor licensed premise. He stated he understands that wait staff will need to transport alcohol back and forth over the sidewalk. Chief Judge Hueser approved the sidewalk service area permit application from Mountain Creole, Inc., Lucile’s, 400 South Meldrum Street. Transfer of Ownership Application from NoCo Liquor Co., dba King’s Liquor, 356 East Harmony Road, #6C, Approved Aleksandr Syjan, representative for NoCo Liquor Co., stated he has been managing the liquor store for several months and is familiar with proper procedures and what is required to properly card patrons. Chief Judge Hueser approved the transfer of ownership application from NoCo Liquor Co., dba King’s Liquor, 356 East Harmony Road, #6C. Transfer of Ownership Application from Fox & Crow, LLC, dba The Fox and The Crow, 2601 South Lemay Avenue, Unit 9, Approved Andrew and Kerry Krekich, representative for Fox & Crow, LLC, briefly described the premises and training employees are required to complete. Chief Judge Hueser approved the transfer of ownership application from Fox & Crow, LLC, dba The Fox and The Crow, 2601 South Lemay Avenue, Unit 9.
