A regular meeting of the Liquor Licensing Authority was held December 16, 2021, in via Zoom Link,
Associate Judge Nieto presiding.
Secretary’s Note: All applications were heard via Zoom.

Show Cause Hearing for Xenia Ventures, LLC, dba
Choice City Butcher & Deli, 104 West Olive Street
Stipulation Agreement Accepted
Russ and Anyssa Robinson, representing Xenia Ventures, LLC, stated he has had an opportunity to
review the stipulation agreement with his client and that they have agreed to the terms.
Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held
in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the
service of an alcoholic beverage to a person under the age of twenty-one years.
Judge Nieto approved the findings, conclusion, and order, accepting the stipulation agreement as
presented for Xenia Ventures, LLC, dba Choice City Butcher & Deli, 104 West Olive Street.

Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 30-day suspension, 10 days served (from start of business January 3rd, 2022 through January
12th, 2022), with 20 days held in abeyance for one year for violating Colorado Liquor Code Section for
44-03-301(4)(a) – local and state liquor licenses were expired, 44-03-302(1) - local liquor license was
not renewed within the forty-five days prior to the date of expiration, 44-03-302(1) – state liquor
license was not renewed within the thirty days prior to the date of expiration, and violation of Liquor
Authority’s Order and Stipulated Agreement dated January 21, 2021.
Judge Nieto approved the findings, conclusion, and order, accepting the stipulation agreement as
presented for S & C Investments, Inc., dba Crystal’s Liquor, 356 East Harmony, Unit #6C.

in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the

Dave Veldman and Martin Johns, representatives for Raintree Athletic Club, LLC, were sworn.
Eva Garretson, representative of Liquor Licensing Professionals, LLC, was sworn. She briefly
described the petitioning process and that this petition indicates strong support for this application.
Dave Veldman stated that they have held a liquor license at their other athletic club at 2555 South
Shields Street. Martin Johns briefly described the training they require employees to complete before
they are allowed to serve alcohol.
Judge Nieto adopted Resolution 2021-027 approving a new beer and wine license application from
Raintree Athletic Club, LLC, dba Alive by Raintree, 932 West Drake Road.

The Waffle Lab, 234 North, Unit A-1 College Avenue, Approved
Rachael Roumaya, representative for Waffle Lab Fort Collins, LLC, was sworn. She stated her
manager, Matthew Derks, conducted the petitioning.
Matthew Derks, petitioner for Waffle Lab Fort Collins, LLC, described the petitioning process and
that all signatures collected indicated support for this application.
In response to questions from the Authority, Ms. Roumaya described the premises. She stated she
would revise the diagram and submit to Deputy City Clerk Jensen.

Judge Nieto adopted Resolution 2021-026 approving a new beer and wine application from The
Waffle Lab Fort Collins, LLC, dba The Waffle Lab at 234 North College Avenue, Unit A-1.
Request to Change the Exchange Promotional Association,
Common Consumption Area at 234 North College Avenue, Approved
Rachael Roumaya briefly reviewed how the Common Consumption Area operates with other the
other members. In response to questions from the Authority, Ms. Roumaya detailed the Common
Consumption Area.
Judge Nieto approved the request to Change the Exchange Promotional Association’s Common
Consumption Area to include The Waffle Lab at 234 North College Avenue.
