Secretary’s Note: All applications were heard via Zoom. Staff in attendance: Adam Stephens, Assistant City Attorney II Carrie Ripsam, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Consent Agenda Approved:  Minutes from the August 19 2021, meeting. Liquor Enforcement Update Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks:  August 26, 2021, visiting 15 liquor licensed establishments of which 3 served the underage operative: a failure rate of 20%.  September 1, 2021, visiting 12 liquor licensed establishments, of which 2 served the underage operative: 16.67% compliance  September 7, 2021, visiting 15 liquor licensed establishments of which 2 served the underage operative: a failure rate of 13.33%.  September 13, 2021, visiting 15 liquor licensed establishments of which 2 served the underage operative: a failure rate of 13.33%. Liquor Enforcement Officer Ripsam stated that the overall failure rate is now 17.45% so far for 2021. Show Cause Hearing for Margaritas Enterprises, Inc., dba 3 Margaritas, 4010 South College Avenue Stipulation Agreement Accepted Andy Gavaldon, attorney representing Margaritas Enterprises, Inc, stated he has had an opportunity to review the stipulation agreement and that his client has agreed to the terms. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Margaritas Enterprises, Inc., dba 3 Margaritas, 4010 South College Avenue. Show Cause Hearing for BD of Colorado, LLC, dba Bad Daddy’s Burger Bar, 347 East Foothills Parkway, #110 Stipulation Agreement Accepted Loren Brown, attorney representing BD of Colorado, LLC, stated he has had an opportunity to review the stipulation agreement and that his client has agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $1129.97 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for BD of Colorado, LLC, dba Bad Daddy’s Burger Bar, 347 East Foothills Parkway, #110. Show Cause Hearing for Old World Foods, LLC, dba Café Athens, 2842 Council Tree Avenue, #149 Stipulation Agreement Accepted Cary Deschene, representative for Old World Foods, LLC, stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held in abeyance for one year for violating City of Fort Collins Municipal Code 3-81 – Report of Disturbances, as amended. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Old World Foods, LLC, dba Café Athens, 2842 Council Tree Avenue, #149. Show Cause Hearing for T.I.P., LLC, dba The Irish Pub, 2439 South College Avenue Stipulation Agreement Accepted Brad March, attorney representing T.I.P., LLC, stated he has had an opportunity to review the stipulation agreement and that his client has agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 7-day suspension, 3 days served (paid $600.05 fine in lieu of suspension), with 4 days held in abeyance for one year for violating City of Fort Collins Municipal code 3-81 – Report of Disturbances as amended. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for T.I.P., LLC, dba The Irish Pub, 2439 South College Avenue. Show Cause Hearing for Stomping Ground Brewery and Restaurant, Inc., dba Obstacle Brewing and Grill, 4613 South Mason Street Stipulation Agreement Accepted Chris Mulligan, representative for Stomping Ground Brewery and Restaurant, Inc., stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $1001.66 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Show Cause Hearing for Ash Company, LLC, dba Urban Air Adventure Park, 4250 Corbett Drive Stipulation Agreement Accepted Scott Hussey, representative for Ash Company, LLC, stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 15-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 10 days held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years. Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Ash Company, LLC, dba Urban Air Adventure Park, 4250 Corbett Drive. Manager Registration Application from 1200 South Coffee, LLC, dba Café Vino, 1200 South College Avenue, Approved Manager applicant was not available. Meeting continued to October 21, 2021. Manager Registration Application from Sage Client 207, LLC & FCMWC, LLC, dba The Elizabeth Hotel 111 Chestnut Street, Approved Dragan Andrejic, manager applicant, stated he has been in the hospitality industry for several years. He briefly described the training required of employees that sell and serve alcohol. Judge Hueser approved the manager registration application from Sage Client 207, LLC, & FCMWC, LLC, dba The Elizabeth hotel 111 Chestnut Street. Transfer of Ownership Application from Aldretex, Inc., dba 287 Craft Spirits, 5846 South College Avenue, Approved Applicant was not available. Meeting continued to October 21, 2021. Transfer of Ownership Application from Magnolia Street Liquors, LLC, dba Magnolia Street Market, 710 East Magnolia Street, Approved Zachary Owens, representative for Magnolia Street Liquors, LLC, stated he previously owned a winery. He stated he will require all employees to complete TIPs or ServSafe training prior to being allowed to work in the store. Mr. Owens stated any employee found in violation of the liquor code will be immediately terminated. New Lodging and Entertainment Liquor License from Game Over Escape Rooms, LLC, dba Time Emporium Escape Rooms, 400 North College Avenue, Unit B, Approved Jeffrey Willy and Noah Kline, representatives for Game Over Escape Rooms, LLC, were both sworn. Mr. Willy stated they have not had any liquor violations at their location in Loveland. He stated all employees will be required to attend TIPS or equivalent training prior to being allowed to sell and serve alcohol. Mr. Willy stated both he and Mr. Kline have completed bartending school. In response to a question from the Authority, Mr. Willy stated termination of an employee that violates the liquor code will depend on the situation. Mr. Kline stated any patron ordering an alcoholic beverage is carded regardless of age. Mr. Willy briefly reviewed the petitions, stating the results show strong support for this liquor license application. Judge Hueser adopted Resolution 2021-002 approving a lodging and entertainment liquor license from Game Over Escape Rooms, LLC, dba Time Emporium Escape Rooms, 400 North College Avenue, Unit B. Other Business Manager Registration Application from Illegal Pete’s, LLC, dba Illegal Pete’s, 320 Walnut Street, Approved Tessa Sutherland, manager applicant, briefly described her background. She stated that all employees involved in the sale and service of alcohol is TIPs trained and that if an employee violates the liquor code they will be immediately suspended and possibly have their employment terminated.
