LIQUOR LICENSING AUTHORITY MINUTES
Regular Meeting. – July 15, 2021

A regular meeting of the Liquor Licensing Authority was held July 15, 2021, in Municipal Court, 215
North Mason Chief Judge Hueser presiding.
Secretary’s Note: All applications were heard via Zoom.

Minutes from the June 17, 2021, meeting.
Liquor Enforcement Update
Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random
compliance checks:
June 17, 2021, visiting 17 liquor licensed establishments of which 2 served the underage
operative: a failure rate of 13.33%.
June 29, 2021, visiting 15 liquor licensed establishments of which 4 served the underage
operative: a failure rate of 26.67%.
July 12, 2021, visiting 17 liquor licensed establishments of which 3 served the underage
operative: a failure rate of 16.66%.
Liquor Enforcement Officer Ripsam stated that the overall failure rate is now 19.89% so far for 2021.

Stipulation Agreement Accepted
George Prine, attorney representing CCC’s Armstrong, LLC, stated he has agreed to the terms of the
stipulation agreement.

Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 30-day suspension, 10 days served (from start of business on Monday, November 15, 2021
to close of business on Wednesday, November 24, 2021), with 20 days held in abeyance for one year
for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic
beverage to a person under the age of twenty-one years and Violation of Liquor Authority’s Order
and Stipulated Agreement dated September 16, 2020.
Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as
presented for CCC’s Armstrong, LLC, dba Armstrong Hotel/Ace Gillette’s, 259 South College
Avenue.
Show Cause Hearing for Backdoor Burger Fort Collins, LLC, dba
Backdoor Burger Grill Fort Collins, 130 West Laurel Street,
Stipulation Agreement Accepted
David Eliason, representative for Backdoor Burger Fort Collins, LLC, stated he has agreed to the
terms of the stipulation agreement.
Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 15-day suspension, 5 days served ($2372.15 paid fine in lieu of suspension), with 10 days
held in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I)
prohibiting the service of an alcoholic beverage to a person under the age of twenty-one years.
Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as
presented for Backdoor Burger Fort Collins, LLC, dba Backdoor Burger Grill Fort Collins, 130 West
Laurel Street.

Canino’s Italian Restaurant, 613 South College Avenue,
Stipulation Agreement Accepted
Clyde Canino, representative for Gaton III, Inc., stated he has agreed to the terms of the stipulation
agreement.
Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 15-day suspension, 5 days served ($500 paid fine in lieu of suspension), with 10 days held
in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the
service of an alcoholic beverage to a person under the age of twenty-one years.
Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as
presented for Gaton III, Inc., dba Canino’s Italian Restaurant, 613 South College Avenue.

Stipulation Agreement Accepted
Jose Alfredo Ibarra, representative for Sofias, Inc., stated he has agreed to the terms of the stipulation
agreement.

Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 35-day suspension, 15 days served (from start of business on Monday, July 26, 2021 to
close of business on Monday, August 9, 2021), with 20 days held in abeyance for one year for violating
Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a
person under the age of twenty-one years, Colorado Liquor Code Section 44-03-301(4)(a) allowing
Local and State liquor licenses to expires, Colorado Liquor Code Section 44-03-302(1) failed to renew
State and Local licenses within required time, Colorado Liquor Rule 47-306 fail to change Trade Name,
and Violation of Liquor Authority’s Order and Stipulated Agreement dated November 19, 2020.
Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as
presented for Sofias, Inc., dba The Chicken Coop, 1006 Spring Creek lane, Unit B-7.
Show Cause Hearing for Harmony Hotels, LLC, dba
Homewood Suites by Hilton, 1521 Oakridge Drive,
Stipulation Agreement Accepted
Christine Stephens, representative for Harmony Hotels, LLC, stated she has agreed to the terms of
the stipulation agreement.
Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 30-day suspension, 10 days served (from start of business on Friday, July 16, 2021, to close
of business on Sunday, July 25, 2021), with 20 days held in abeyance for one year for violating
Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a
person under the age of twenty-one years, Colorado Liquor Rule 47-913 licensee shall not permit a
person between the ages of 18 and 21 to serve alcohol beverages unless they are supervised by another
person at least 21 years of age, Colorado Liquor Code Section 44-03-302(1) licensee failed to renew
state and local license within required time.
Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as
presented for Harmony Hotels, LLC, dba Homewood Suites by Hilton, 1521 Oakridge Drive.

Stipulation Agreement Accepted
Glenn Haas, representative for Rockies Food, LLC, stated he has agreed to the terms of the stipulation
agreement.
Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 30-day suspension, 10 days served (from start of business on Sunday, July 18, 2021, to
close of business on Tuesday, July 27, 2021), with 20 days held in abeyance for one year for violating
Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a
person under the age of twenty-one years and Violation of Liquor Authority’s Order and Stipulated
Agreement dated December 17, 2020.
Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as
presented for Rockies Food, LLC, dba Krazy Karl’s, 1124 West Elizabeth Street.

Stipulation Agreement Accepted
Woodrow Saunders, representative for Liquor Kabinet, Ltd, stated he has agreed to the terms of the
stipulation agreement.
Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 15-day suspension, 5 days served (paid $5000 fine in lieu of suspension), with 10 days held
in abeyance for one year for violating Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the
service of an alcoholic beverage to a person under the age of twenty-one years.
Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as
presented for Liquor Kabinet, LLC, dba Liquor Kabinet, 3035 West Prospect Road.
Show Cause Hearing for RC Restaurants, LLC, dba
Fuzzy’s Taco Shop, 1335 West Elizabeth
Stipulation Agreement Accepted
Marc Rogers, representative for RC Restaurants, LLC, stated he has agreed to the terms of the
stipulation agreement.
Assistant City Attorney Scurlock reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 30-day suspension, 10 days served (from start of business on Monday, July 26, 2021, to
close of business on Wednesday, July 28, 2021), with 20 days held in abeyance for one year for violating
Colorado Liquor Code Section 44-3-901(1)(b)(I) prohibiting the service of an alcoholic beverage to a
person under the age of twenty-one years and Violation of Liquor Authority’s Order and Stipulated
Agreement dated August 19, 2020.
Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as
presented for RC Restaurants, LLC, dba Fuzzy’s Taco Shop, 1335 West Elizabeth Street.
Manager Registration Application from
The Kitchen Cafe, LLC, dba
Next Door American Eatery, 100 North College Avenue, Approved
Reese Donah, manager applicant, briefly described her background. She stated that all employees
involved in the sale and service of alcohol is TIPs trained and that if an employee violates the liquor
code they will be immediately suspended and possibly have their employment terminated.
Judge Hueser approved the manager registration application from The Kitchen Café, LLC, dba Next
Door American Eatery, 100 North College Avenue.

Modification of Premise Application from
Himalayan Bistro, Inc., dba
Himalayan Bistro, 2720 Council Tree Avenue, Suite 184, Approved
Dawa Sherpa, representative for Himalayan Bistro, Inc., stated he is adding a patio to the front of his
restaurant. In response to questions from the Authority, Mr. Sherpa stated the patio is fully visible to
staff inside the restaurant.
Judge Hueser approved the modification of premise application from Himalayan Bistro, Inc., dba
Himalayan Bistro, 2720 Council Tree Avenue, Suite 184.
Transfer of Ownership Application from
SweetWater Colorado Brewing Company, dba
SweetWater Brewery, 1020 East Lincoln Avenue, Approved
Laird Mulderink, representative for SweetWater Colorado Brewing Company, stated any employees
found in violation of the liquor code would be immediately terminated. In response to questions from
the Authority, Mr. Mulderink described the premises.
Judge Hueser approved the transfer of ownership application from SweetWater Colorado Brewing
Company, dba SweetWater Brewery, 1020 East Lincoln Avenue.
Change in Location Application from Totally 80’s Pizza, dba
Totally 80’s Pizza, from 1717 South College Avenue,
to 2567 South Shields Street, Unit 4A, Approved
Alex Morgan, representative for Totally 80’s Pizza, stated he is hoping to be opened at 2567 South
Shields Street by end of August. He stated he is working with Poudre Fire Authority to make sure all
requirements are met.
Judge Hueser adopted Resolution 2021-018 approving the change in location application from Totally
80’s Pizza, dba Totally 80’s Pizza, from 1717 South College Avenue to 2567 South Shields Street.
New Lodging and Entertainment Liquor License Application from
JDRA, LLC dba Woodhouse Day Spa – Fort Collins,
401 Linden Street Units 1-010, 1-020, 1-103 & 1-105, Approved
Brandon Sandberg, attorney representating for JDRA, LLC, stated John Eric Weiss and Dana Marie
Weiss, are available for questions from the Authority.
Mr. Weiss stated this spa will be unique to Northern Colorado and, in response to questions from Mr.
Sandberg, described training all employees involved with the sale and service of alcohol will be
required to completed before serving. He stated other Woodhouse Spas’ in Colorado also hold a liquor
license. Mr. Weiss provided details of where the liquor will be stored and how drinks will be served.

Judge Hueser adopted Resolution 2021-016 approving a lodging and entertainment liquor license
application from JDRA, LLC dba Woodhouse Day Spa – Fort Collins, 401 Linden Street Units 1-010,
1-020, 1-103 & 1-105.
