Box 580 Fort Collins, CO 80522.0580 970.416.2740 970.224.6134- fax fcgov.com Planning, Development & Transportation TO: Tammi Pusheck, Interim City Clerk FROM: Michelle Haefele, Chair Planning & Zoning Commission DATE: November 18, 2021 SUBJECT: Planning and Zoning Commission 2021 Summary & 2022 Work Plan Planning & Zoning Commission at a Glance • The Planning and Zoning Commission’s responsibilities include making recommendations to the City Council regarding zoning, annexations, land use code amendments, major public and private projects and any legislative or long-range planning activities (such as City Plan or subarea plans) that require Council approval. • The Commission is the final decision-making authority regarding land use proposals, including overall development plans, project development plans, major amendments and planned unit development master plans for projects under 640 acres in size. • The Commission is composed of seven volunteer members, with interest or expertise in land use planning, architecture, engineering, construction, historic preservation, real estate, and related fields. 2021 in Review The Planning & Zoning Commission continued to review a significant caseload of development applications in 2021. Due to the ongoing impacts of the COVID-19 pandemic, the Commission held virtual work sessions and hearings through May 2021. From June through October, the Commission shifted to hybrid work sessions and hearings, which allowed for both in-person and virtual participation by Commissioners, the public, and City staff. In addition to all regularly scheduled meetings, three additional special meetings were held in November 2020, May 2021, and June 2021 to keep pace with an increased number of projects. From May through October, there was one vacant position on the Commission; a new Commissioner was appointed by City Council in October 2021. The following projects were reviewed by the Commission between November 2020 and October 2021: • Precision Technology – Project Development Plan • Maverik – Project Development Plan • Fort Collins Loveland Water District Golden Currant Water Line – Site Plan Advisory Review • Colorado Department of Transportation Port of Entry – Site Plan Advisory Review • H-25 Multi-Family – Project Development Plan • King Soopers #146 Midtown Gardens Marketplace – Project Development Plan • Guardian Self Storage – Project Development Plan • Apex-Haven Apartments – Project Development Plan • Sam’s Club Fuel Station – Major Amendment and Addition of Permitted Use (DENIED) • Magnolia Dwellings – Project Development Plan • Mosaic Neighborhood Center – Project Development Plan • West Willox Urban Estate Density Modification Request • Stanford Senior Living – Project Development Plan • The Quarry – Project Development Plan • East Parks District Maintenance Facility – Major Amendment • Sanctuary on the Green – Project Development Plan (Item continued at hearing, then withdrawn from review process by applicant) • Northern Integrated Supply Project (NISP) – Site Plan Advisory Review • Chabad Jewish Center Basic Development Review – Extension Request • Larimer County Alternative Sentencing – Site Plan Advisory Review • Timberline-International – Project Development Plan and Addition of Permitted Use • Appeal of Landmark Apartments Planned Unit Development (PUD) Minor Amendment • Northfield Commons – Major Amendment • Fairway Apartments – Project Development Plan • Mars Landing – Project Development Plan • The Foothills Sun Communities – Project Development Plan • Fort Collins Loveland Water District – Overall Development Plan The following decisions of the Commission were appealed to City Council to-date in 2021: • Guardian Self Storage Project Development Plan (decision upheld by City Council) • Sam’s Club Fuel Station Major Amendment and Addition of Permitted Use (pending, scheduled for January 2022) In addition to project reviews within the Commission’s decision-making authority, the Commission also made recommendations to City Council on the following projects: Annexation: • Springer-Fisher Annexation and Zoning • Gil Boyer Annexation and Zoning • Northeast Prospect & I-25 Frontage Road Annexation and Zoning Rezoning: • Northeast Prospect & I-25 Rezoning Addition of Permitted Use: • East Parks District Maintenance Facility – Addition of Permitted Use • Fort Collins Loveland Water District – Addition of Permitted Use Plans, Policies, and Code Updates: • Creation of a Manufactured Housing Zone District • Annual Land Use Code Amendments • Three-Mile Plan 2020 Update • Residential Metropolitan District Evaluation Process • Housing Plan Recommendation • Lighting Code Amendments • Land Use Code Amendments – Second Kitchens and Minor Amendment/Basic Development Review Appeal Provisions • Water Conservation Land Use Code Amendments • Wireless Telecommunications Master Plan The Commission also provided input on several projects that are still in progress, including: • Land Use Code Update – Phase 1 • North College MAX Plan • Mountain Avenue Reshaping Project • 1041 Regulations • East Mulberry Plan Update • Building Code Amendments 2022 Initiatives and Ongoing Projects In addition to evaluating development proposals, the Commission anticipates committing time to a number of important policy issues in 2022, including: • Land Use Code Update – Phase 1 (Housing Barriers) – The Commission will discuss and provide input on potential Land Use Code amendments, with the goal of implementing policy direction from City Plan, the Housing Plan, and other plans and policies. Priorities include promoting attainable housing and addressing barriers that impact housing supply and affordability. • East Mulberry Plan Update and Annexation – The Commission will regularly discuss and provide input on the update to the East Mulberry Plan, in anticipation of long-term annexation. This is a multi-year effort that began in 2019. • Wireless Telecommunication Land Use Code Amendments – The Commission will provide input on code amendments to implement the Wireless Telecommunications Master Plan, which will focus on the siting and design of wireless facilities. • Oil and Gas Code Update – The Commission will provide input on potential Land Use Code regulations for oil and gas development within city limits. The purpose of the code is to regulate where oil and gas development should occur within the community and surface impacts from oil and gas development in a manner that protects public health, safety, welfare, the environment and wildlife resources. • 1041 Regulations – The Commission will review and discuss regulations for activities of statewide interest pursuant to the 1041 state statute. The regulations will seek to protect the community’s natural resources from the impact of large-scale infrastructure projects. • Water Adequacy Determination Process – The Commission will provide input on the creation of a formal process for evaluating water service and supply plans for development projects that propose a “non-standard” approach to water provision. • Landscaping Code Amendments – A number of City departments are collaborating to identify potential code amendments to support Council priorities related to urban tree canopy, xeriscape, and Nature in the City. The Commission may be consulted on proposed code amendments, and would provide a formal recommendation to City Council if needed. • North College Corridor Plan Amendment and Rezoning – Following the creation of a new Manufactured Housing Zone district, staff has been pursuing rezoning projects to protect existing manufactured housing communities from redevelopment. One potential rezoning along North College may necessitate an amendment to the North College Corridor Plan.
